With your visit and / or purchase of tickets, you accept the general terms and conditions of the Archduke Franz Ferdinand Museum, Artstetten Castle.


1. Scope
The general terms and conditions of the Archduke Franz Ferdinand Museum govern the legal relations between the visitors on the one hand and the Archduke Franz FerdinandMuseum on the other hand. In the event that an admission ticket is passed on, it is the responsibility of the Vorherige purchaser to point out that the General Terms and Conditions of the Archduke Franz Ferdinand Museum apply to all further visitors. The terms and conditions are part of all contracts between the visitors on the one hand and the Archduke Franz Ferdinand Museum on the other hand.


2. Ticket Prices
The prices of the Archduke Franz Ferdinand Museum apply in accordance with the applicable price lists. The prices shown on the price lists include the respective legally prescribed value added tax. The Archduke Franz Ferdinand Museum reserves the right (especially in the case of special exhibitions) to set prices that deviate from the price lists in individual cases. Discounted tickets can only be purchased by individual interested parties if they belong to one of the respective beneficiary groups. The beneficiaries include schoolchildren, students, senior citizens, families and groups of 15 or more. There is no legal entitlement to discount tickets. Only one card is issued per interested party. The discount cards are invalid without a photo ID justifying the benefit. In the event of improper use of a card, the difference may be collected or the visitor to the museum expelled. In the latter case, the purchase price of the ticket will not be partially refunded.
 
3. Ticket Purchase
The Archduke Franz Ferdinand Museum always endeavours to offer all interested parties the best possible service when purchasing tickets. However, there is no legal entitlement for interested parties to purchase or reserve one or more tickets for exhibitions or other events of the Archduke Franz Ferdinand Museum. Tickets for exhibitions of the Archduke Franz Ferdinand Museum are available at the cash desk of the Archduke Franz Ferdinand Museum during the respective opening hours.  The Archduke Franz Ferdinand Museum reserves the right to refuse to purchase tickets for a certain period of time or, in serious cases, on a permanent basis to interested parties who disrupt the orderly sale of tickets or other interested parties or visitors or who contravene the respective house rules or instructions of the ticket office staff. Tickets shall be paid for in cash, by ATM or credit card. The Archduke Franz Ferdinand Museum reserves the right to set a minimum amount below which payment by credit card will not be accepted.


4. Return of or replacementfor tickets
It is not possible to return or exchange paid cards. No refund can be made for lost tickets of any kind or for tickets that have not been used or only partially used. This applies in particular to “late arrivals” shortly before the museum closes.


5. Cancellation or alteration of exhibitions, guided tours or other special events
If an exhibition or other special event whose title is printed on the ticket, which has been advertised in any other way or whose tickets were purchased for the sole purpose of visiting it is replaced, postponed or cancelled by another, tickets already purchased and not used shall not be taken back by the Archduke Franz Ferdinand Museum. Admission tickets entitle the holder to visit all exhibition rooms of the Archduke Franz Ferdinand Museum open at the time of the visit, irrespective of any exhibitions, guided tours or other special events announced. Even limited viewing possibilities due to the temporary closure of some rooms due to the operation of events or for conservation reasons are in no case a reason for the return of tickets. The Archduke Franz Ferdinand Museum expressly reserves the right to close any rooms due to weather conditions or events. Postponements or cancellations of guided tours or events also do not entitle the purchaser to return purchased tickets. However, postponements of guided tours of more than 2 hours entitle the purchaser to a refund of the tour fee. It is the visitor’s responsibility to inform himself on the day of the tour or event about any changes, e.g. through the media or by telephone at the Archduke Franz Ferdinand Museum.


6. Claims for damages
Claims for damages of the customer for whatever legal reason, in particular due to impossibility of performance, are excluded unless they are based on intent or gross negligence of the Archduke Franz Ferdinand Museum. This limitation does not apply to the compensation of damages to persons and to objects handed over for processing as well as to damages according to the Product Liability Act.


7. Other
By entering the premises of the Archduke Franz Ferdinand Museum, the visitor submits to the house rules in force at the time. Upon request, a valid admission ticket must always be presented to the staff of the Museum Service. In the event of violations of the house rules of the Archduke Franz Ferdinand Museum, the visitor may be expelled from the exhibition or guided tour. The purchase price will not be refunded in such cases. Austrian law applies. For entrepreneurs and consumers who do not have their place of residence or habitual abode in Austria and who are not employed in Austria, the court responsible for 3661 Artstetten is agreed as the competent court for all legal disputes in connection with this contract, even if it concerns its conclusion or dissolution. We reserve the right to amend and adapt the General Terms and Conditions as necessary, whereby the amendment shall only apply to future contract conclusions.

With your booking you accept the general terms and conditions of Schloss Artstetten BetriebsGmbH.

These terms and conditions for events in Artstetten Castle (hereinafter referred to as “Castle”) or bookings of packages (such as champagne reception in the museum/private rooms, etc.) are part of the contract of the order placed by you. Other conditions of the castle are invalid or must be specified in writing in the contract. The organizer is subject to these terms and conditions as well as all relevant trade law and other regulations and assumes liability for their observance by his signature.

 

1. Down payment for fix booking of an appointment:

50% of the room rental / package sum after the event:

Balance The Castle reserves the right not to carry out the event if the deposit is not available to us under the above conditions.

 

2. Guarantee of the participating persons

If catering has been ordered (in particular for packages), the organizer must provide precise details of the persons taking part no later than four working days prior to the event. This number shall be regarded as the guaranteed minimum number of participants, which shall also be invoiced to the Organiser if the number of actually participating guests is lower.  Should the number of participating guests exceed the minimum number of participants specified by the Organiser, the Castle will charge for services such as meals, drinks, etc. in addition (i.e. if the guaranteed minimum number of participants is 100 and the actual number of participants is 80, 100 persons will be charged; if the guaranteed minimum number of participants is 100 and the actual number of participants is 120, 120 persons will be charged).

 

3. Cancellation of events or packages

Up to 30 working days before the event, 30% of all agreed services (based on the number of persons requested) must be paid.  Up to 20 working days prior to the event, 75% of all agreed services (based on the number of persons requested) are payable.  Up to 10 working days prior to the event, the total costs of the agreed services will be invoiced.  This includes Menu and buffet, drinks, room rental and personnel costs, technical equipment, cloakroom, musical supporting programme, any decoration, as well as any other extra services separately agreed by the castle.

 

4. Technicians work

If technical work is required for the event, this will be carried out by the castle, among others, outside companies, and the organizer will be charged with the costs incurred.

 

5. Beverage billing

If no quantitative or financial limit has been agreed in writing with the castle, all drinks will be charged according to actual consumption.

 

6. Food and drinks

Gastronomy is provided exclusively by the castle or its catering partner. No food or drinks may be brought into the castle for consumption without the written confirmation of the management. The castle reserves the right to charge a handling fee for food and drinks brought along.

 

7. Valuables  

Valuables such as machines, pictures, cash, etc. brought by the participants of the event are under no circumstances subject to the liability of the castle. The castle offers the possibility of taking out an appropriate insurance policy at the organiser’s expense.

 

8. Decoration  

The Organiser is obliged to inform the Castle in writing of the intended installation of decorative material or other objects and to obtain its consent. The event rooms may not be damaged, the decoration should correspond to the style of the house. The installation must be carried out by qualified personnel. Furthermore, all fire police regulations must be observed.

 

9. Registration and permits

All official approvals and tax registrations for the event are the responsibility of the organizer.

 

10. Music

Should the organizer plan musical performances during the event, he is obliged to give the details to the castle in good time, so that various alterations can be made on time. All costs, including AKM and amusement tax, will be borne by the organizer.

 

11. Liability

For damages caused by guests, employees or agents of the organizer, the latter is liable himself. These are to be fully reimbursed to the castle. The castle reserves the right to take out the corresponding insurance policies in the name and for the account of the organiser. In order to cover damages not covered by insurance (e.g. vandalism), the Organiser must deposit a security deposit in good time.

 

12. Security

If the situation requires it, the organizer has to order a security company at his expense. The main aim is to minimise the risk of damage from crimes such as theft, vandalism, etc. and to keep insurance premiums low.

 

13. Cleanliness

In the event of soiling of the castle by guests or agents of the organizer beyond the normal extent, the cleaning costs exceeding those of the standard cleaning will be charged to the organizer.

 

14. Handover of the rooms to the organizer

Before the start of the event, the rented premises must be inspected by an authorised representative of the castle and an authorised representative of the organiser. After the end of the event (or after the dismantling work) such an inspection, in which the above-mentioned authorized persons participate, must also take place in order to document any damage. 

 

15. Procedure

At the latest one week before the event, a schedule and construction plan of the event must be submitted to the castle.

 

16. Termination by the castle

The castle is entitled to terminate the contractual relationship at any time and without stating reasons, if – the event endangers the smooth running of the business – the reputation and the security of the house are endangered – in case of non-compliance with official requirements – the down payment agreed in point 1 not in time In the case of force majeure In no case is the organizer entitled to assert claims for damages against the castle.

By booking you accept the General Terms and Conditions of the Archduke Franz Ferdinand Museum, Schloss Artstetten.

1. General

1.1 These General Terms and Conditions apply to all contracts concluded by Schloss Artstetten BetriebsGmbH (hereinafter referred to as SAB) with voucher customers.  

1.2 A voucher agreement can only be concluded by licensed travel agencies and licensed tour guides and hotels.

1.3 Within the framework of the SAB voucher system, the admission fees for visits to the Archduke Franz Ferdinand Museum are charged cashlessly between SAB and the voucher customer.

1.4 Customers without an Austrian bank account undertake to deposit an interest-free securities account in the amount of EUR 400 for the first year of the Voucher Agreement by paying into an account specified by SAB. In the following years, the amount of the deposit to be deposited shall be determined on the basis of the maximum monthly turnover of the Vorherige year, but shall not be less than EUR 400. The deposit shall remain with SAB until termination of the voucher agreement and shall serve to secure SAB’s claims. The deposit shall not be offset against current invoices of the Voucher Client.

1.5 Voucher customers must cancel reservations for visits that are not used in a timely manner. Cancellations of visits that are not required must be made by e-mail or telephone at least 24 hours prior to the date in question.

2. Billing  

2.1 SAB calculates the voucher monthly, subject to point

2.2 based on the actual number of visitors.

2.3 Deviations of the actual number of persons from the number of visitors indicated on the voucher must be noted in writing on the voucher. This note must be confirmed by the authorised representative of the Voucher Customer (tour guide) with his signature. Only if such a written note has been signed can deviations in the number of persons be taken into account in the settlement.

2.4 The voucher customer can only object to the monthly billing of vouchers until the 20th of the following month. Thereafter, the billing is considered approved.

3. Prices

3.1 All agreed prices are Euro prices incl. the statutory value added tax.

3.2 If the voucher prices change, SAB shall at the same time send the voucher customer price recommendations for end customer tickets. These recommended prices correspond to the ticket prices published on the SAB website.

3.3 No price lower than the official list price may be communicated to the end customer. The contracting parties agree on confidentiality with regard to voucher prices. The Voucher Customer undertakes not to make voucher prices directly accessible to third parties. It is not permitted to undercut the official list prices.

3.4 If you take advantage of reduced prices (e.g. for children, pupils, students), you must prove your eligibility for the discount at the cash desk.

4. Payment

4.1 The voucher customer must make the payment within 14 days from the invoice date.

4.2 For customers without an Austrian bank account (deposit regulation according to item 1.4), a payment period of 14 days after receipt of invoice shall apply. The securities account to be set up in accordance with Section 1.4 shall serve exclusively to secure SAB’s claims and not to pay current invoices.

4.3 The voucher customer must indicate his name, invoice number and amount when making payments.

4.4 If the invoice is not paid within the set period (pursuant to 4.1 or 4.2), SAB shall send a reminder with costs. If no payment is made within one week of the first reminder, the Voucher Client shall be blocked. SAB shall no longer redeem the Client’s vouchers from the time of blocking; reservations made by the Voucher Client shall be rejected from the time of blocking; existing reservations shall be cancelled. The customer can only visit the Archduke Franz Ferdinand Museum against cash payment.

4.5 In the event of default in payment, default interest at a rate of 8% above the respective base interest rate published by the OeNB shall be charged for the period from the due date until receipt of payment (§ 352 UGB). In the event of default in payment, reminder charges of € 10,– will be charged for each reminder. After an unsuccessful third reminder, a debt collection agency shall be commissioned to collect the claim at the expense of the Voucher Customer. SAB shall be entitled to claim from the Voucher Customer full reimbursement of all collection costs caused by the Voucher Customer’s default in payment, unless the Voucher Customer is not responsible for the default in payment.

4.6 SAB reserves the right to charge the voucher customer for any claims for damages resulting from non-compliance with payment agreements.

4.7 All payments of the voucher customer shall first be offset against interest and expenses still outstanding and only then against invoices for voucher entries.

4.8 The reference to defects shall not release the voucher customer from his obligation to comply with the terms of payment. The voucher client expressly waives its right to set off its own claims, for whatever title and legal relationship, against claims of SAB or to retain or reduce the services owed, for whatever reason.

4.9 If the voucher client’s financial circumstances deteriorate or if SAB only becomes aware after conclusion of the contract that the voucher client’s financial circumstances were so poor at the time of conclusion of the contract that fulfilment of the voucher client’s contractual obligations was jeopardised, SAB may refuse performance until the counter-performance has been effected or secured. Evidence of such financial circumstances on the part of the voucher client shall be deemed to have been furnished by the information provided by a reputable credit agency or bank.

5. Disruptions and liability

5.1 SAB shall not be liable for default or impossibility of performance as a result of force majeure (e.g. strike, fire, war, theft, etc.) or for reasons beyond the control of SAB.

5.2 SAB shall be liable for default or impossibility of performance for reasons other than those specified in Section 5.1, provided that at least gross negligence exists.

5.3 SAB shall be liable for any damage incurred by the Voucher Client only to the extent that it or one of its vicarious agents is guilty of intent or gross negligence. Liability shall generally be limited to an amount equal to 10% of the net turnover from the already effected ticket sale to end customers.

5.4 Liability for loss of profit, consequential damage or damage due to claims by third parties is excluded.

6. Other
